Receivership, State Dissolution Proceedings and Collections

Though bankruptcy proceedings under Federal law are often the preferred alternative to receivership proceedings and dissolutions under state law,  such receivership proceedings and dissolutions still occur with some frequency.  Potter Anderson & Corroon can guide clients through these murky areas of the law.  The firm advises clients with respect to both judicial and extra-judicial dissolution and winding-up procedures under the Delaware General Corporate Law, as well as state law receivership proceedings.  In this regard, the firm's Bankruptcy and Corporate Reorganization group works closely with the firm's Corporate Counseling group.  Two of the firm’s corporate partners, Donald J. Wolfe, Jr. and Michael A. Pittenger, have authored the well-respected treatise Corporate and Commercial Practice in the Delaware Court of Chancery, which contains one of the more expansive discussions of these areas of the law.     

Additionally, Potter Anderson & Corroon has extensive experience in more traditional state law collection and creditor enforcement actions before the Superior Court of the State of Delaware.  Our experience includes commercial foreclosures, attachments and replevin actions.
